1. Acceptance of Terms
Welcome to CarCheck UK Ltd ("CarCheck", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, services, and products.
By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our services.
These Terms constitute a legally binding agreement between you and CarCheck UK Ltd. Please read them carefully before using our services.
2. Service Description
CarCheck provides comprehensive vehicle history checking services in the United Kingdom. Our services include:

We aggregate data from official sources including the DVLA (Driver and Vehicle Licensing Agency), DVSA (Driver and Vehicle Standards Agency), MIAFTR (Motor Insurance Anti-Fraud and Theft Register), and authorized finance databases.
3. User Obligations
When using our services, you agree to:
Provide Accurate Information
Supply truthful, accurate, and complete information when creating an account or making purchases.
Use Services Lawfully
Use our services only for legitimate purposes and in compliance with all applicable laws and regulations.
Protect Account Security
Maintain the confidentiality of your account credentials and notify us immediately of any unauthorized access.
Respect Intellectual Property
Not reproduce, distribute, or create derivative works from our content without explicit permission.
Important Notice
You are responsible for all activities conducted through your account. Any violation of these obligations may result in immediate termination of your access to our services.
4. Account Registration
To access certain features and purchase premium reports, you must create an account.
Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to create an account.
Account Information
You must provide:
- Valid email address
- Secure password (minimum 8 characters)
- Accurate billing information for paid services
Account Security
You are solely responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized use of your account at security@carcheckuk.co.uk.
One Account Per User
Each account is personal to you and may not be shared, transferred, or sold to others. Creating multiple accounts to circumvent restrictions is prohibited.
5. Pricing & Payment Terms
5.1 Pricing
Current pricing for our services is displayed on our website. All prices are in British Pounds Sterling (GBP) and include VAT where applicable.
Price Changes: We reserve the right to modify our pricing at any time. Price changes will not affect orders already placed but will apply to future purchases.
5.2 Payment Methods

5.3 Payment Processing

5.4 Failed Payments
If a payment fails or is declined, we will notify you via email. We may suspend access to purchased reports until payment is successfully processed. Repeated payment failures may result in account suspension.
5.5 Invoices & Receipts
VAT invoices and receipts are automatically sent to your registered email address upon successful payment. You can also download them from your account dashboard.
6. Refund Policy
Digital Goods Notice
Our vehicle reports are digital goods delivered instantly upon payment. Under the Consumer Contracts Regulations 2013, you acknowledge that you are requesting immediate delivery and therefore waive your 14-day cancellation right once the report is generated.
6.1 When Refunds Are Available
We offer refunds in the following circumstances:
Technical Failure
You paid but did not receive a report due to a system error on our end
Duplicate Charge
You were accidentally charged multiple times for the same report
Data Unavailable
The vehicle data is not available in our databases and we cannot generate a report
6.2 When Refunds Are NOT Available
Change of Mind
Once a report is successfully generated and delivered, we cannot offer a refund simply because you changed your mind
Unfavorable Results
Refunds are not available if the report contains information you were hoping not to find (e.g., outstanding finance, previous damage)
User Error
If you entered an incorrect vehicle registration number, we cannot offer a refund
6.3 Requesting a Refund
To request a refund, please contact us within 7 days of purchase:

Please include your order number, email address, and reason for the refund request. We will review your request and respond within 3-5 business days.
6.4 Refund Processing
Approved refunds will be processed to the original payment method within 5-10 business days. You will receive an email confirmation once the refund is issued.
7. Data Accuracy & Disclaimer
IMPORTANT DISCLAIMER
While we strive to provide accurate and up-to-date vehicle information, CarCheck UK Ltd acts as an information provider aggregating data from third-party sources. We do not guarantee the absolute accuracy, completeness, or timeliness of the information provided.
7.1 Data Sources
Our reports compile information from:
- •DVLA: Vehicle registration, tax, and keeper information
- •DVSA: MOT test history and results
- •MIAFTR: Stolen vehicle and insurance write-off records
- •Finance Companies: Outstanding finance agreements
- •Industry Databases: Mileage records and specification data
7.2 Limitations
Data Lag: There may be a delay between when an event occurs (e.g., finance settlement, MOT test) and when it appears in our databases, typically 7-14 days.
Missing Information: Not all data is recorded or available for every vehicle, particularly older vehicles or those with limited history.
Third-Party Errors: We rely on the accuracy of data provided by third parties and cannot be held responsible for errors in their records.
7.3 Your Responsibility
You acknowledge and agree that:

- ⚠You should conduct your own independent verification and inspection before purchasing a vehicle
- ⚠We recommend professional mechanical inspection for any used vehicle
- ⚠You should not rely solely on our reports when making purchasing decisions
7.4 Reporting Inaccuracies
If you believe any information in our report is inaccurate, please contact us at dataaccuracy@carcheckuk.co.uk with supporting documentation. We will investigate and, if necessary, request corrections from the relevant data source.
8. Intellectual Property Rights
8.1 Our Content
All content on our website and in our reports, including but not limited to text, graphics, logos, icons, images, software, and compilation of data, is the property of CarCheck UK Ltd or its licensors and is protected by UK and international copyright laws.
The CarCheck name, logo, and all related trademarks are owned by CarCheck UK Ltd. Unauthorized use of our trademarks is strictly prohibited.
8.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to:
- ✓Access and use our website for personal, non-commercial purposes
- ✓Download and print vehicle reports you have purchased for your personal use
- ✓Share purchased reports with potential buyers/sellers of the specific vehicle checked

9. Prohibited Uses
You agree not to use our services for any unlawful or prohibited purpose, including:

Technical Abuse
- • Hacking or unauthorized access
- • Introducing viruses or malware
- • Overwhelming our systems (DDoS)

- • Automated bulk checking
- • Circumventing payment systems
Content Violations
- • Posting false information
- • Impersonating others

Enforcement
Violation of these prohibitions may result in immediate termination of your account, legal action, and reporting to appropriate authorities. We reserve the right to cooperate with law enforcement agencies.
10. Limitation of Liability

Please read this section carefully as it limits our liability and your legal remedies.
10.1 Service Provided "As Is"
Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10.2 No Liability for Indirect Damages
To the fullest extent permitted by law, CarCheck UK Ltd shall not be liable for:

- •Loss of profits, revenue, data, or business opportunities
- •Damages arising from purchasing a vehicle based on our reports
- •Service interruptions, errors, or inaccuracies in data
- •Unauthorized access to or alteration of your data
10.3 Maximum Liability
In no event shall CarCheck UK Ltd's total liability to you for all claims arising out of or related to our services exceed the amount you paid us in the twelve (12) months preceding the claim, or £100, whichever is greater.
10.4 Exceptions
Nothing in these Terms shall exclude or limit our liability for:
- ✓Death or personal injury caused by our negligence
- ✓Fraud or fraudulent misrepresentation
- ✓Any liability that cannot be excluded or limited under UK law
10.5 Consumer Rights
If you are a consumer, your statutory rights under UK consumer protection laws are not affected by these Terms. You may have additional rights that cannot be excluded or limited.
11. Indemnification
You agree to indemnify, defend, and hold harmless CarCheck UK Ltd, its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:
1. Your use or misuse of our services
2. Your violation of these Terms
3. Your violation of any rights of third parties
4. Your violation of applicable laws or regulations
5. Any content you submit or transmit through our services
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.
12. Termination
12.1 Termination by You
You may terminate your account at any time by:
- •Using the account deletion feature in your account settings, or
- •Contacting us at support@carcheckuk.co.uk
Upon termination, you will still have access to previously purchased reports but cannot generate new ones without reactivating your account.
12.2 Termination by Us
We reserve the right to suspend or terminate your account immediately, without prior notice, if you:
Breach these Terms - Including prohibited uses or intellectual property violations
Engage in Fraudulent Activity - Payment fraud, identity theft, or abuse
Pose a Security Risk - Hacking attempts or system abuse
Violate Laws - Use our services for illegal purposes
12.3 Effect of Termination
Upon termination of your account:
- •Your right to access and use our services will immediately cease
- •We will delete your account information in accordance with our Privacy Policy
- •Previously purchased reports may be retained as per data retention policies
- •No refunds will be provided for unused services or subscription fees
- •Sections of these Terms that by nature should survive will remain in effect
13. Governing Law & Jurisdiction
These Terms and any disputes arising out of or related to them or our services shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
Jurisdiction
You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation.
Consumer Rights
If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts. Nothing in these Terms affects your statutory rights.
14. Dispute Resolution
We are committed to resolving disputes amicably and efficiently:
Step 1: Contact Us
If you have a complaint or dispute, please first contact our customer service team at support@carcheckuk.co.uk. We will make every effort to resolve the issue within 14 days.
Step 2: Formal Complaint
If not resolved to your satisfaction, you may submit a formal written complaint to our Complaints Department at complaints@carcheckuk.co.uk. We will investigate and respond within 28 days.
Step 3: Alternative Dispute Resolution
If we cannot resolve the dispute internally, you may use an alternative dispute resolution (ADR) service. We recommend:

Step 4: Legal Proceedings
As a last resort, you may initiate legal proceedings in accordance with the Governing Law section. We hope to resolve all disputes without litigation.
EU Online Dispute Resolution
The European Commission provides an online dispute resolution platform for consumers at ec.europa.eu/consumers/odr. However, we are not obliged to participate in this platform.
15. Changes to These Terms
We reserve the right to modify these Terms at any time to reflect changes in our services, legal requirements, or business practices.
How We Notify You
- • We will post updated Terms on this page with a new "Last Updated" date
- • For material changes, we will notify you via email at least 30 days before they take effect
- • We may also display a prominent notice on our website
Your Options
If you do not agree with the modified Terms:
- • You may discontinue using our services
- • You may close your account before the changes take effect
